Terms of Service

These Terms of Service ("Terms") govern your use of the WearTime mobile application ("App") operated by Shore Thing Services LLC ("we," "our," or "us"). By downloading, installing, or using the App, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using the App, you confirm that you:

• Are at least 13 years of age
• Have the legal capacity to enter into these Terms
• Accept and agree to be bound by these Terms
• Agree to comply with all applicable laws and regulations

If you do not agree to these Terms, you must not use the App.

2. Description of Service

WearTime is a mobile application that allows users to:

• Track and manage their watch collection
• Log wear time for each watch
• Store photos and notes about watches
• View statistics and insights about wearing habits
• Set service reminders and notifications

3. Free Trial

We offer a 45-day free trial that provides full access to all Pro features. The trial begins when you first install and open the App. During the trial period:

• No payment information is required
• You have access to all Pro features
• Your data will be preserved after the trial ends
• You can subscribe at any time during or after the trial

After the trial expires, access to certain Pro features will be restricted until you subscribe.

4. Subscription Terms

4.1 Subscription Options

We offer the following subscription plans:

• Monthly: $1.99 USD per month
• Yearly: $12.00 USD per year (equivalent to $1.00/month)

4.2 Billing

• Subscriptions are billed through your Apple ID account
• Payment is charged upon confirmation of purchase
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period

4.3 Free vs. Pro Features

Free Tier includes:

• Up to 3 watches in your collection
• 1 photo per watch
• Basic wear tracking and statistics
• 1 daily reminder

Pro Subscription includes:

• Unlimited watches
• Up to 15 photos per watch
• Advanced statistics and insights
• Wear diary entries
• Service reminders
• Up to 5 daily reminders
• Multi-watch wearing (up to 6 watches simultaneously)
• Data export

4.4 Cancellation

You may cancel your subscription at any time through your Apple ID account settings. Cancellation takes effect at the end of the current billing period. You will retain access to Pro features until the end of your paid period.

4.5 Refunds

Refunds are handled by Apple according to their refund policies. To request a refund, visit reportaproblem.apple.com.

5. User Content

5.1 Your Content

You retain ownership of all content you create in the App, including:

• Watch collection data
• Photos you upload
• Diary entries and notes
• Custom settings and preferences

5.2 Content Responsibility

You are solely responsible for:

• The accuracy of information you enter
• Ensuring you have rights to any photos you upload
• Backing up your data if desired
• The security of your device and Apple ID

5.3 Data Storage

Your data is stored locally on your device. If you enable iCloud sync, data is also stored in your personal iCloud account. We are not responsible for data loss due to device failure, iCloud issues, or user error.

6. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose
• Attempt to reverse engineer, decompile, or disassemble the App
• Circumvent any access controls or usage limits
• Share your subscription with others
• Use the App to infringe on intellectual property rights
• Transmit malware or harmful code

7. Intellectual Property

The App, including its design, features, code, and content (excluding user content), is owned by Shore Thing Services LLC and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.

8. Third-Party Services

The App integrates with third-party services:

• Apple Services: App Store, StoreKit, iCloud, and Push Notifications are subject to Apple's terms

We are not responsible for third-party services and their availability, accuracy, or terms.

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE
• ACCURACY OR RELIABILITY OF ANY INFORMATION
• UNINTERRUPTED OR ERROR-FREE OPERATION
• COMPATIBILITY WITH YOUR DEVICE

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SHORE THING SERVICES LLC SHALL NOT BE LIABLE FOR:

• ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES
• LOSS OF DATA, PROFITS, OR BUSINESS OPPORTUNITIES
• DAMAGES RESULTING FROM YOUR USE OR INABILITY TO USE THE APP
• DAMAGES EXCEEDING THE AMOUNT YOU PAID FOR THE APP IN THE PAST 12 MONTHS

11. Indemnification

You agree to indemnify and hold harmless Shore Thing Services LLC from any claims, damages, losses, or expenses arising from your use of the App or violation of these Terms.

12. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms in the App and updating the "Last updated" date. Your continued use of the App after changes constitutes acceptance of the new Terms.

13. Termination

We may terminate or suspend your access to the App at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

14. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Delaware.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Shore Thing Services LLC regarding the App.
